Sawyer v. CNA
After the untimely death of her fiancée, Laura Sawyer sued Continental Assurance Company for failing to timely pay the life insurance benefits owed under his policy. The trial court granted summary judgment in favor of the carrier on the issue of punitive damages. Ms. Sawyer filed a writ and requested the Court of Appeal to review this decision. The Court of Appeal in an unpublished decision Sawyer v. Superior Court, California Court of Appeal, Second District, Case Number B144143, filed March 23, 2001, ruled that Ms. Sawyer could present her case for punitive damages to the jury. Based in part on this decision, the carrier quickly settled with Ms. Sawyer.
