Automobile Insurance Litigation Case Results

Toroussian v. Mid-Century Insurance Company 
An unknown perpetrator vandalized Sevan Toroussian’s car by breaking its window and pouring paint throughout the interior of the car. Mid-Century failed to compensate Mr. Toroussian for the damages to his vehicle on the grounds that Mr. Toroussian had vandalized his own car and that Mr. Toroussian had not cooperated in the adjustment of his claim. This claim recently settled favorably for Mr. Toroussian.

Hernandez v. Permanent General Insurance Company 
Ms. Hernandez’s Nissan Altima was stolen from her carport. She reported the theft to her car insurance company, Permanent General. Permanent General denied the claim accusing Ms. Hernandez of stealing her own car. After the unpublished decision in Permanent General Insurance Company v. Superior Court in 2004 requiring the production of Permanent General’s claims files for similarly situated insureds, Ms. Hernandez entered into a favorable settlement with Permanent General.
